II - Scope of Services

Our platform provides an online community space, educational content, and promotional information dedicated to the Algarve's native Negra Mole grape, alongside organizing and selling tickets to curated cultural, social, and interactive wine events (including but not limited to urban pop-ups, winery picnics, game nights, and heritage walks).

 

Some events may take place in collaboration with partner venues, such as wineries, tasting rooms, or hospitality establishments.

 

III - Ticket Purchasing & Checkout Flow

• Age Restriction: You must be at least 18 years old to purchase tickets or attend any events involving alcohol consumption.

• Order Confirmation: Your order constitutes an offer to purchase. The contract is finalized only when payment is cleared and a ticket confirmation is sent to your email address.

• Billing & Invoicing: All payments are securely processed via Stripe. In compliance with Portuguese tax law, invoices are automatically generated and issued using Invoice Express (an AT-certified billing software). You must provide a valid Tax Number (NIF) at checkout if you wish it to appear on your invoice.

IV - Right of Withdrawal

• Legal Exclusion for Dated Events: In accordance with Article 17, paragraph 1, point k) of Decree-Law no. 24/2014, the standard 14-day right of withdrawal for distance contracts does not apply to services related to leisure activities provided on a specific date or period.

• Final Sales: Therefore, all event ticket sales are final. No refunds or exchanges are permitted if you change your mind or are unable to attend.

• Ticket Transferability: You may transfer or gift your ticket to another person (aged 18+), provided you notify us via email or WhatsApp at least 24 hours prior to the event start time with the new attendee's name.

 

V - Event Cancellation, Postponement, or Alteration

• Cancellation by Us: If we cancel an event due to logistical failures or unforeseen circumstances, a 100% refund of the face-value ticket price will be issued to your original payment method via Stripe.

• Force Majeure & Weather: For outdoor events (such as vineyard picnics), execution is weather-dependent. We reserve the right to modify elements of the event format or postpone it to ensure safety. If postponed, tickets remain valid for the new date.

• Third-Party Locations: Events hosted at partner bars, restaurants, or wineries are subject to those venues’ house rules. We are not responsible for individual venue admittance policies.

 

VI - Minimum Participants

Certain events or activities may require a minimum number of participants.

If the minimum number is not reached, Negra Mole Experience may:

• reschedule the activity, or

• issue a full refund.

 

VII - Alcohol Consumption

Some events or activities may include wine tastings or alcoholic beverages.

Participation in these activities is restricted to individuals 18 years of age or older, in accordance with Portuguese law.

 

Participants are expected to consume alcohol responsibly. Negra Mole Experience reserves the right to refuse service of alcohol or remove participants from the event or activity without refund if behaviour is considered unsafe or intoxicated.

 

Participants remain responsible for their own wellbeing and for complying with all applicable laws regarding alcohol consumption.

 

VIII - Health Conditions

Participants are responsible for ensuring that they are physically able to participate in the activity.

​Clients must inform Negra Mole Experience in advance of any relevant health conditions that may affect their participation.

 

IX - Dietary Restrictions and Allergies

Some experiences may include food tastings provided by partner venues.

Participants must inform Negra Mole Experience in advance of any dietary restrictions or allergies.

​While reasonable efforts will be made to communicate this information to partner venues, Negra Mole Experience cannot guarantee the absence of allergens and cannot be held responsible for reactions caused by third-party food providers.

 

X - Third-Party Venues and Services

Certain activities may take place at wineries, restaurants, or other venues operated by third parties.

​These venues operate independently and are responsible for their own products, facilities, and services.

​Negra Mole Experience cannot be held responsible for the acts, omissions, or operational decisions of such third-party providers.

 

XI - Liability and Insurance

Negra Mole Experience holds the civil liability insurance required under Portuguese legislation for tourist animation activities.

Activities are conducted with reasonable care and professionalism.

However, Negra Mole Experience shall not be liable for:

• loss or damage to personal belongings

• injuries resulting from failure to follow instructions

• circumstances beyond reasonable control.

 

XII - Personal Data Protection

By completing a purchase or joining our wine community, your personal data is handled in accordance with the GDPR and the Portuguese Law:

• Your data is shared with Stripe (payment processing) and Invoice Express (legal tax compliance).

• If you opt-in to our community or newsletter platform, you agree to receive email communications regarding upcoming ticket releases and event updates. You can opt-out at any time via the unsubscribe link.

Manuela Defrancesco, the owner of Negra Mole Experience brand, is not bound by adherence or legal imposition resulting from mandatory arbitration to any consumer dispute resolution entity.

XVII - Applicable Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with Portuguese law. Any disputes arising from these terms or our events that cannot be settled amicably shall shall be submitted to the competent Portuguese court of the district of Portimão, with express waiver of any other jurisdiction, where legally permissible.

XVIII - Validity of Clauses
